[03/23/06] URGENT APPEAL: Justice for Victims of the Massacre of Felisburgo!

The MST’s Human Rights Sector is asking for your urgent support and solidarity.
On November 20, 2004, 18 armed gunmen, commanded by the rancher Adriano Chafik, attacked the MST’s Terra Prometida (Promised Land) encampment. They shot and killed five rural workers, wounding another 12. This sad episode became known in Brazil as the Massacre of Felisburgo. [See ‘BACKGROUND’ @ BOTTOM OF PAGE].
In the second half of 2005, rancher Adriano Chafik was indicted by the Public Ministry of Minas Gerais, which determined the need for Chafik to stand trial by jury. In an attempt to delay the proceedings and avoid punishment, Chafik has appealed the ruling. The MST is demanding Chafik be brought to trial, and asks for your urgent support!

Dear sirs,
On November 20, 2004, 18 armed gunmen, commanded by the rancher Adriano Chafik Luedy and his cousin Calixto Luedy, invaded the Terra Prometida (Promised Land) Camp, in Felisburgo, Minas Gerais, killing rural workers Iraguiar Ferreira da Silva, Miguel José dos Santos, Joaquim José dos Santos, Juvenal Jorge da Silva and Francisco Ferreira do Nascimento (73 years old).
In this barbaric criminal action, they wounded with gunshot another 12 workers, burned shacks and the local school, and left hundreds of families with nothing but the clothes on their backs.
The Massacre of Felisburgo shocked Brazilian and international society and once again stained the history of our country with the blood of those who want only a piece of land to live on and to raise their children.
Today, of the 16 people accused by the Public Ministry, only three are in jail and another eight are considered fugitives from justice.
In the second half of 2005, the judge of the region of Jequitinhonha pronounced sentence against five of the accused. Adriano Chafik appealed that decision to the Court, aiming once again to postpone the trial that would certainly culminate in his conviction.
We are aware of the zeal with which this court has treated this case, including twice denying requests for freedom formulated by the person who authored and ordered the barbarous crime.
Given the seriousness of this barbarous crime that caused so many repercussions nationally and internationally, given the feeling of impunity that rules in society and the need for the accused to be put on trial by the Jury Court so that they may be finally punished, we are putting our hopes on your Excellencies, requesting that the appeal referred to above should be ruled on as quickly as possible.
Certain of the spirit of justice that permeates the decisions of this Court, we hope for the highest level of consideration for this request.

Exmo Srs. Desembargadores,
No dia 20 de novembro de 2004, dezoito pistoleiros armados e comandados pelo fazendeiro Adriano Chafik Luedy e seu primo Calixto Luedy invadiram o acampamento Terra Prometida, em Felisburgo, Minas Gerais, assassinando os trabalhadores rurais Iraguiar Ferreira da Silva, Miguel José dos Santos, Joaquim José dos Santos, Juvenal Jorge da Silva e Francisco Ferreira do Nascimento, esse último com 73 anos de idade.
Nessa bárbara ação criminosa feriram a bala outros doze trabalhadores, queimaram barracos e a escola local, deixando centenas de famílias somente com a roupa do corpo.
A Chacina de Felisburgo chocou a sociedade brasileira e internacional e mais uma vez maculou a história de nosso país com o sangue daqueles que querem apenas um pedaço de terra para viver e criar seus filhos.
Hoje, dos dezesseis denunciados pelo Ministério Público, apenas três estão presos e outros oito, desde o início do processo, ainda estão foragidos da justiça e da aplicação da lei.
No segundo semestre de 2005 o juízo da Comarca de Jequitinhonha proferiu sentença de pronúncia contra cinco dos acusados. Contra essa decisão, Adriano Chafik apresentou a este Tribunal recurso em sentido estrito, visando mais uma vez protelar o andamento do processo que certamente culminará em sua condenação.
Sabemos do zelo com que este Tribunal tem tratado este processo, tendo inclusive, por duas vezes, negado os pedidos de liberdade formulados pelo mandante e autor direto do bárbaro crime.
Diante da gravidade desse bárbaro crime que causou comoção e repercutiu em âmbito nacional e internacional, diante do sentimento de impunidade que impera na sociedade e da necessidade de que os acusados sejam levados a julgamento pelo Tribunal do Júri para que enfim sejam punidos, voltamos nossas esperanças a Vossas Excelências, pedindo que o referido recurso seja julgado com a máxima urgência possível.
Certos do espírito de justiça que permeia as decisões desse Tribunal, renovamos nossos protestos da mais elevada consideração.

On November 20, 2004, 18 armed gunmen, commanded by the rancher Adriano Chafik Luedy and his cousin Calixto Luedy, invaded the Terra Prometida (Promised Land) Camp, in Felisburgo, Minas Gerais, killing five rural workers--Iraguiar Ferreira da Silva, Miguel José dos Santos, Joaquim José dos Santos, Juvenal Jorge da Silva and Francisco Ferreira do Nascimento (who was 73 years old).
In this barbarous criminal action, they wounded another 12 workers, burned shacks and the local school, and left hundreds of families with nothing but the clothes on their backs.
The workers had been camped for two and a half years in the area, recognized by the State as unoccupied, and were constantly threatened by the rancher and claim-jumper Adriano Chafik.
This sad episode in Brazil became known as the Massacre of Felisburgo.
More than a year after the terrible episode, there was no punishment for any of the killers involved in the massacre, eight killers are fugitives from justice, and the families in the camp are still waiting for a settlement in that area.
For having placed public order at risk and by legal decree, Adriano Chafik was ordered jailed under preventive detention. Two requests for habeas corpus by his lawyers were denied by the Court of Justice of Minas Gerais.
However both times, Minister Gilson Dipp of the Superior Court of Justice decided to free him. So Adriano Chafik has been free since December 14, 2005-- a fact that horrifies society, which wants to see justice done.
Today, only the guilty parties Erisvaldo Pólvora, Washington Agostinho, and Jailton Guimarães are in jail.
In the second half of last year, an indictment was handed down that accepted all the terms of the accusation made by the Public Ministry of Minas Gerais and specified that Adriano Chafik, Washington Agostinho, Francisco de Oliveira, Milton de Souza, and Admilson Lima should be tried by the Jury Court.
In an attempt to postpone the trial, Adriano Chafik Luedy and Washington Agostinho da Silva appealed this ruling in November 2005 to the Court of Justice of Minas Gerais.
At this time the appeal is ready to be heard by the Court of Justice of
Minas Gerais.

Nessa bárbara ação criminosa feriram a bala outros doze trabalhadores, queimaram barracos e a escola local, deixando centenas de famílias somente com a roupa do corpo.
Os trabalhadores estavam há dois anos e meio acampados na área, reconhecida pelo Estado como devoluta, e eram ameaçados constantemente pelo latifundiário e grileiro Adriano Chafik.
Esse triste episódio brasileiro ficou conhecido como a Chacina de Felisburgo.
Mais de um ano após o terrível episódio, não houve punição para nenhum dos assassinos envolvidos na Chacina de Felisburgo, oito assassinos estão foragidos da justiça e as famílias acampadas ainda aguardam a implantação do assentamento na área.
Por colocar em risco a ordem pública e a instrução do processo, o Fazendeiro Adriano Chafik, teve por duas vezes a prisão preventiva decretada. Seus advogados entraram com pedidos de habeas corpus que foram nas duas oportunidades negados pelo Tribunal de Justiça de Minas Gerais.
Porém, em ambas as vezes, o Ministro Gilson Dipp do Superior Tribunal de Justiça, decidiu por sua libertação. Dessa forma, desde 14 de dezembro de 2005 Adriano Chafik está em liberdade, o que causa verdadeiro horror para a sociedade que quer e deseja que seja feita justiça.
Hoje, apenas os réus Erisvaldo Pólvora, Washington Agostinho e Jailton Guimarães estão presos.

Neste momento o Recurso se encontra pronto para ser levado a julgamento pelo Tribunal de Justiça de Minas Gerais.
Dessa forma, visando dar maior celeridade ao processo, pedimos a todos/as que encaminhem mensagens para o Tribunal de Justiça de Minas Gerais manifestando o desejo de que o Recurso seja julgado o mais brevemente possível.
