Parliamentarians Denounce Impeachment to the OAS

The Parliamentarians have requested the Inter American Commissioners of Human Rights (CIDH),

Federal deputies Paulo Pimenta (PT), Paulo Texeira (PT) and Wadih Damos (PT) and Senator Télmario Mota (PDT) issued a measure along with the Inter American Commissioners of Human Rights (CIDH) in reference to the impeachment process against the removed President Dilma Rousseff.

linked to the OAS, to take three measures regarding the Brazilian State: the immediate restitution of Dilma in the Presidency; the annulment of all the actions related to the impeachment process; the halting of the impeachment process until the Commissioner can analyze the case.

The parliamentarians informed that this request opens up a new international phase of denounce of the impeachment process in a new attempt to revert the decision of the Senate to continue the case against the elected President. “We identified various violations that took place during the process in the Chamber of Deputies and in the Senate and, unfortunately, also in the Supreme Court”. explained Deputy Paulo Pimenta.

The document was filed on Thursday night (August 9) in Washington, in the United States, where the headquarters of the OAS is located. According to the parliamentarians the petition was issued by jurists and lawyers from Brazil and also from other countries.

As Brazil is a member of the OAS and signer of diverse international pacts, in case of obtaining the green light from the Commissioner regarding the need of Dilma to retake her post, the Brazilian State will be forced to comply the decision.

Process

Regarding the actions that took place in the Chamber, the parliamentarians argued that the voting was irregular because the so-called “Control of Conventions” established by the American Convention on Human Rights (1969) was ignored. They argue that the guarantees for the removed President were violated in several ways.

One of the violations is that of the “principle of non-discrimination”, because the process had President Dilma as the main objective, but arbitrarily excluded her successor, Michel Temer, who faces a denounce on the same accounts: a type of public administration actions that Brazilians call “fiscal peddling”.

The OAS Commission attended the request because of the petition was based on the jurisprudence of the Inter.American Court of Human Rights of the OAS, which has already been cited in similar cases, such as the ones of Venezuela and Colombia.

Deputy Paulo Pimenta added that they didn’t resort to the OAS before because the Inter American Commission of Human Rights demanded that the internal instances should be exhausted before the case could be internationally investigated.

According to another Deputy, Paulo Teixeira, the initiative of the group was communicated to President Dilma Rousseff. He highlighted that one of the arguments in favor of Dilma is that she has no criminal condemnations. “She is doesn’t have condemnations, furthermore she has no criminal denounces against her. The opening of that process was, actually, a threat” affirmed the Parliamentarian, in allusion to the Deputy and former President of the Chamber, Eduardo Cunha (PMDB-RJ).
